1. Agreement to Terms

By accessing or using Saengsa ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

2. Description of Service

Saengsa provides website uptime monitoring services that include:

  • Real-time website availability monitoring
  • Response time tracking and analytics
  • Downtime alerts via email and integrations
  • Historical uptime data and reporting
  • Multi-location monitoring (Pro and Business plans)
  • API access for advanced integrations (Business plan)

3. Account Registration

  1. You must provide accurate and complete information when creating an account.
  2. You are responsible for maintaining the security of your account credentials.
  3. You must notify us immediately of any unauthorized use of your account.
  4. One person or legal entity may not maintain more than one free account.

4. Subscription Plans and Billing

4.1 Available Plans

  • Free Plan: 3 sites, 5-minute checks, 7-day history
  • Starter Plan: $9/3 months, 25 sites, 1-minute checks, 30-day history
  • Pro Plan: $24/3 months, 100 sites, 30-second checks, 90-day history
  • Business Plan: $69/3 months, 500 sites, 15-second checks, 365-day history

4.2 Billing Terms

  1. All paid plans are billed every 3 months in advance.
  2. Payments are processed by Paddle.com, our merchant of record.
  3. Prices are in USD and may be subject to taxes based on your location.
  4. Plan upgrades take effect immediately with prorated billing.
  5. Plan downgrades take effect at the end of the current billing period.

5. Refund Policy

  1. We offer a 14-day money-back guarantee for all paid plans.
  2. Refund requests must be submitted within 14 days of the initial purchase.
  3. Refunds are not available for renewal payments.
  4. To request a refund, contact support@saengsa.com with your account details.

6. Acceptable Use Policy

You agree not to:

  • Monitor websites you don't own or have permission to monitor
  • Use the service for illegal or unauthorized purposes
  • Attempt to bypass any service limitations
  • Interfere with or disrupt the service or servers
  • Transmit viruses, malware, or malicious code
  • Reverse engineer or attempt to extract source code
  • Resell or redistribute the service without permission

7. Service Limitations

  1. Check intervals and site limits are enforced based on your plan.
  2. Historical data retention is limited by your plan (7-365 days).
  3. API rate limits apply to prevent abuse.
  4. We reserve the right to throttle excessive usage.

8. Data and Privacy

  1. We collect and process data according to our Privacy Policy.
  2. You retain ownership of your monitoring data.
  3. We will not sell or share your data with third parties.
  4. You can export or delete your data at any time.

9. Service Availability

  1. We strive for 99.9% service uptime but do not guarantee uninterrupted service.
  2. Scheduled maintenance will be announced in advance when possible.
  3. We are not liable for downtime caused by factors outside our control.

10. Intellectual Property

  1. The Service and its original content remain the property of Saengsa.
  2. You grant us permission to use your logo/name for marketing purposes unless you opt out.
  3. Your monitoring data remains your property.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAENGSA SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or data loss
  • Damages exceeding the amount paid for the service in the past 3 months

12. Indemnification

You agree to indemnify and hold harmless Saengsa from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

13. Changes to Terms

  1. We may modify these Terms at any time.
  2. Material changes will be notified via email or service announcement.
  3. Continued use after changes constitutes acceptance of new Terms.

14. Termination

  1. You may cancel your account at any time.
  2. We may suspend or terminate accounts that violate these Terms.
  3. Upon termination, your data will be deleted after 30 days.
  4. Paid subscriptions remain active until the end of the billing period.

15. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
